SURVEYOR SUBSCRIPTION TERMS, CONDITIONS AND USE AGREEMENT

Overview and Purpose: This Web Site is a service made available by SURVEYSEARCH.NET (herein after Provider). This Web Site contains a searchable directory of surveyors and land which they have surveyed. By providing a search directory, information in the Web Site will assist consumers locate a surveyor in their geographic location and also to locate a surveyor who may be familiar with a particular geographic location based on survey work the surveyor has conducted in that particular geographic location. The Web Site is also a database where Surveyors with interest in surveying a particular geographic location may search to see if any surveying has previously been conducted in that geographic location. The use of this Web Site is subject to the agreement of the following terms and conditions:
1. Surveyor Listings: The surveyor will provide their name, address,e-mail and phone number. The surveyor will also provide their license number and professional liability insurance information.
2. Surveyor Work Product: The surveyor will download the addresses, including plat and lot, of all property which that surveyor has work compiled. The surveyor will then indicate if an official survey was completed.
3. Fee and Payment: The Provider reserves the right to modify the prices after the end of the subscription period. The subscribed fee will automatically renew at the end of the renewal period unless subscriber notifies Provider prior to the renewal period. Provider reserves the right to terminate a subscriber for any reason at its discretion. Provider shall not be held liable for any breeches in transaction security by third parties. See disclaimer and limitation of liability number 7.
4. Fee and Payment for Wholesaler: See Wholesaler Terms, Conditions and Use Agreement.
5. Permitted Uses: Access to the Web Site is conditioned upon the compliance of the Terms and Conditions of Use herein described. The Web Site must be used solely for purpose of locating a surveyor and or work product of a surveyor. The user is allowed to print out information and search results from the Web Site solely for this purpose. Use of the information obtained on the Web Site for commercial purposes is prohibited.
6. Copyright, Trademark and Violations of Use: Use is conditioned on and subject to the user, subscriber or wholesaler NOT: copying, printing, republishing, transmitting, distributing, in any form or by any means any portion of the Web Site, or its data contents, using the data and or information contained on the Web Site to create a similar information storage and retrieval system, database, that is offered for commercial distribution of any kind, including through sale, license, subscription; Create compilations or derivative works of the Surveyor Directory or any other materials from the Web Site; use the Surveyor Directory or any other materials from the Web Site in any manner that may infringe any copyright, intellectual property right, proprietary right, or property right of provider; Decompile, disassemble or reverse engineer any Web Site software or use any network monitoring or discovery software to determine the site architecture; use any automatic or manual process to harvest information from the Web Site; User agrees that all right, title and interest (including all copyrights, trademarks, service marks, patents and other intellectual property rights) in this Web Site and its content belong to Provider.
7. Disclaimer and Limitation of Liability: Provider disclaims any loss, damages or injury incurred in any way through its Web Site. Such damages include special, direct, indirect, incidental or consequential. Provider does not warrant or guarantee any survey created by the surveyors listed on its Web Site, nor does it warrant or guarantee any work which resulted from or was created through any relationship derived through the Web Site directory. This includes but is not limited to the particular surveyor's license and insurance. All users of the Web Site are encouraged to make their own independent investigation and evaluation of any Surveyor they might consider hiring for professional surveying services and or using any of their survey work product. Any professional relationship created through third parties by and through this website is a relationship between the consumer and or surveyor and does not involve the Provider. You agree to hold Provider harmless and indemnify it for any claims made against it in connection with any relationship derived from this Web Site. Provider also does not represent or warrant that the Web Site will be free of viruses. PROVIDER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTY OF MERCHANTABILITY AND WARRANTY OF A PARTICULAR PURPOSE. Although Provider has contracted with a reputable company to provide payment system services, Provider is not responsible for any loss or damage incurred as a result of a security breach or compromise which allowed access to users payment information.
8. Advertisers: Provider is not responsible for the accuracy or legality of any advertisements posted on its Web Site.
9. Links: Provider is not responsible for any information derived from Links located from its Web Site to a third parties web page. Absolutely no warranties are made as to the content, legality or reliability of the content of third party sites by Provider.
10. Violations of Agreement: Any violations of this agreement may terminate the user's access to the Web Site and Provider may take any remedies available. Any information obtained by the user through its use of the Web Site may be used for taking any action available.
11. Prohibited Email Solicitation: The use of the information obtained on the Web Site, specifically the names and addresses, email or regular mail, to transmit unsolicited bulk commercial email to surveyors, consumers or other third parties or over the Internet is strictly prohibited.
12. Governing Law, Jurisdiction and Non-Waiver: These Terms and Conditions of Use are governed by and construed in accordance with the laws of the State of Rhode Island and any action arising out of or relating to these terms shall be filed only in state or federal courts located in Rhode Island and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action, The failure of either party to enforce any rights hereunder shall not constitute a waiver of any terms or conditions of these Terms and Conditions of Use.
13. Modifications to Terms of Use: Provider reserves the right to change these Terms and Conditions of Use at any time. Updated versions of the Terms and Conditions of Use will appear on this Web Site and are effective immediately. You are responsible for regularly reviewing the Terms and Conditions of Use. Continued use of the Web Site after any such changes constitutes your consent to such changes.
